These Terms of Service ("Terms") constitute a legal agreement between you ("you" or "User") and 1w Daily Desk developed by pscudtech ("we," "us," or "our"). By downloading, installing, or using our mobile application ("the App"), you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Acceptance of Terms
By accessing or using the App, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
The App provides guided office stretching routines, breathing exercises, wellness tips, custom workout building, progress tracking, and motivational content. The App is intended for general wellness purposes only and does not constitute medical advice.
3. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device for your own non-commercial use, subject to these Terms. You may not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer or attempt to extract the source code of the App
- Use the App for any unlawful purpose or in any way that could damage, disable, or impair the App
- Remove or alter any proprietary notices or labels on the App
4. Health Disclaimer
The exercises, stretches, breathing techniques, and wellness tips provided by the App are for informational and general wellness purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any new exercise program, especially if you have pre-existing health conditions. You assume all risks associated with using the exercises and information provided by the App.
5. User Content
You may create custom workout routines and configurations within the App. You retain ownership of any content you create. By using the App, you grant us permission to store this content locally on your device to provide the App's functionality.
6. Intellectual Property
All content, features, functionality, design elements, graphics, and trademarks within the App are owned by us or our licensors and are protected by intellectual property laws. Unauthorized use of any materials may violate copyright, trademark, and other applicable laws.
7. Push Notifications
The App may send push notifications for stretch reminders and breathing break alerts. You can manage or disable these notifications through your device settings at any time.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.
9. Updates and Changes
We may update the App from time to time to add new features, fix bugs, or improve performance. We may also update these Terms at any time. Continued use of the App after changes constitutes acceptance of the revised Terms.
10. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App is immediately revoked. You may terminate your use at any time by uninstalling the App.
11. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage arising out of or in connection with your use of the App.
13. Indemnification
You agree to indemnify, defend, and hold harmless 1w Daily Desk developed by pscudtech from and against any claims, liabilities, damages, losses, and expenses arising from your use of the App or violation of these Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
